The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

As per allegation in the FIR , on 07.11.2021the informant who is working as field staff in Bharat Finance Inclusion Ltd. Jhaha, went to Sono for recovery and recovered Rs.92,549/- from different centers. In the way to Jhaha branch three unknown persons on motorcycle in covered face intercepted the informant on the point of pistol and snatched key of motorcycle and from box of motorcycle taken collected money and Tab-Biomatric Tab, mobile, Aadhar-card, PAN card and Rs. 1200/- from him and thereafter they fled away.

It is submitted by learned counsel for the petitioner

that the petitioner is innocent and has committed no any offence. The petitioner is not named in the F.I.R. and he has falsely been implicated in the present case on the basis of confessional statement of co-accused which has no evidentiary value in the eye law. Neither anything has been recovered from the possession of the petitioner nor he has been put on T.I.P. till date. The petitioner is languishing in judicial custody since 11.05.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sono P.S. Case No. 315 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui.
