At the outset, learned counsel for the petitioners

seeks permission to withdraw this bail petition, so far as petitioner no. 1 (Ravindra Singh) is concerned.

Accordingly, in respect of petitioner no.1, this anticipatory bail petition is dismissed as withdrawn.

The petitioners (petitioners no. 2 & 3) apprehend their arrest in a case registered for the offence under Sections 341, 323, 324, 307, 34 of the Indian Penal Code.

On account of property dispute between the parties, a simple occurrence of Maarpeet took place, in which, informant sustained injury. Both parties are close pattidars .

Allegation of assault is general and omnibus. Specific allegation of assault is against co-accused Ravindra Singh. Two title suits i.e. Title Suit No. 40 of 2008 and Title Suit No. 743 of 2017 are pending between the parties before the learned Court below.

Learned counsel for the State and informant vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances, let the petitioners no. 2 and 3, as named above, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VII, Siwan in connection with Mairwa P.S. Case No. 329 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This application is, accordingly, disposed of.
