2 15-03-2023 The present petition has been filed for restoration of Criminal Miscellaneous Case No. 57879 of 2022, which has stood dismissed on account of non-prosecution by an order dated 16.01.2023.
The learned counsel for the petitioner submits that on account of the learned counsel for the petitioner being engaged in some other Court, he could not attend the hearing of the present case, when the case was called out, resulting in dismissal of the present petition on account of non-prosecution.
Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner as also taking into account the

averments made in the present case, I deem it fit and proper to direct for restoration of the aforesaid petition bearing Criminal
Miscellaneous No.57879 of 2022 to its original file.
