The present petition has been filed seeking the

following reliefs :-

“(a) To direct respondents to remove the encroachment from public land, Aam Rasta/ govt land situated at Thana no. 310, vill+Post+ P.S.+Anchal Chainpur appertaining to Khata no. 817, Khesra no. 1322 which is registered in khatiyan as Anabad Bihar Sarkar Rasta.

(b) To direct the respondents to initiate a land encroachment case against the encroacher and remove the encroachment from the aam rasta so that free movement on

road by public and local villagers may be restored and the people of village may move freely without any hindrance.”

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Chainpur for redressal of his aforesaid grievances. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Chainpur by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid
