Heard learned counsel for the petitioner, learned counsel for the State as well as learned counsel for the informant.

The FIR arises out of Charpokhari P.S. Case No. 240 of 2015 registered under Sections 147, 148, 149, 341, 323, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the allegation that has been attributed to the petitioner in the FIR does not match with the injury report inasmuch as the opinion was reserved by the doctor at that particular time.

However, counsel for the informant submits that the said statement in the injury report where the opinion has been

reserved in no way exonerates with the petitioner of the charges which is levelled in the FIR.

The petitioner is the main assailant as alleged in the FIR. The matter dates back to 2015. Despite specific allegation against him, he evaded arrest for five years.

In the aforesaid circumstance, as this Court does not deems it proper to enlarge the petitioner on bail, the same is accordingly, rejected.

Since, the FIR dates back to 2015, the Trial Court is directed to expedite the trial and conclude the same at the earliest.

The bail application is rejected with the aforesaid observation.
