Heard the learned counsel for the parties.

The petitioner seeks bail in connection with

Banka P.S. Case No. 771 of 2021, dated 19.09.2021,

¶20

instituted for the offences under Sections 302 and 34 of the Indian Penal Code.

The thirteen years old son of the informant

¶22

went missing and later, his dead-body was recovered from a water body. The informant has suspected the

hands of the petitioner and others in the occurrence. The reason for suspecting the hands of the petitioner and others is that in the year 2020, the petitioner was an accused in a case lodged by the sister-in-law of the informant.

Apart from the vague suspicion that the petitioner along with others may have had his hand in the killing of the deceased, there is no tangible material collected during the course of investigation.

The learned counsel for the petitioner has submitted that except for the suspicion of the informant, there is no other cogent material to warrant the continued detention of the petitioner in custody.

The petitioner is in custody since 18.03.2022.

This Court has also been informed that two

other similarly situated accused persons have been granted bail by different Benches of this Court.

Considering the facts afore-stated, the

petitioner, above-named, is directed to be released on
