Learned counsel for the petitioners is directed to

At the outset, the learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application

as against petitioner no.2.

Permission is accorded. The application is accordingly dismissed as withdrawn as against petitioner no.2.

Petitioner nos. 1, 3, 4, 5, 6, 7, 8, and 9 apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 308, 354 and 379 of the Indian Penal Code, registered in connection with Gaighat P.S.Case No. 189 of 2021.

Learned counsel for the petitioners has submitted that there is specific allegation of assault on petitioner to the nephew of the informant. So far as other petitioners are concerned, the allegation against them is general and omnibus in nature. Petitioners are persons of clean antecedent.

Considering the above facts and circumstances, let petitioner nos. 1, 3, 4, 5, 6, 7, 8, and 9, above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Muzaffarpur in connection with Gaighat P.S.Case No. 189 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all the defects are removed by the petitioners within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
