The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 232, 354B, 379, 504, 509/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that three persons riding on a motorcycle tried to outrage the modesty of the daughter of the informant and when the informant and his son protested, they were assaulted by the accused persons.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case as the petitioner has no concern with the alleged occurrence. It is further submitted that petitioner and the

informant were known to each other from before but the FIR has been registered against unknown, which creates serious doubt about the authencity of the FIR. It is also submitted that on the alleged date of occurrence, the petitioner being Hawaldar was on duty at B.M.P. at Balmikinagar, Bagha, which gets reflected from Annexure-2 to this petition.

Learned APP for the State has opposed the prayer of bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Patna in connection with Hawai Adda P.S. Case No. 262 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
