Heard learned counsel for the petitioner and learned

The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 10.02.2022, charge-sheet has been submitted in this case and has antecedent of two cases.

Allegation is of recovery of 533.880 litre of liquor from a Bolero vehicle.

The learned counsel for the petitioner submits that petitioner is neither the owner, nor the driver of the vehicle. He was mere a passenger and thus, was not knowing what was kept in the vehicle.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody,

charge-sheet has been submitted in this case and is not the owner and driver of the vehicle, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hasanpur P. S. Case No.31 of 2022.
