The present case has been taken out of turn based on the mentioning made by the learned Senior Counsel for the petitioner on the ground that son of the petitioner is to be married on 22.04.2022.

Heard learned Senior Counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court.

The petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

Learned Senior Counsel for the petitioner submits that the petitioner is in custody since 30.12.2021, charge-sheet has been submitted and has antecedent of two cases.

persons, on the point of pistol, took away the iron rods of the informant which were to be used in the construction work.

Learned Senior Counsel for the petitioner submits that the FIR was registered against unknown and name of the petitioner transpired during course of investigation in the confessional statement of co-accused Birendra Kumar. Learned Senior Counsel submits that Birendra Kumar, in whose confessional statement name of the petitioner transpired, has already been granted bail by order dated 22.06.2021 in Cr. Misc. No. 6625 of 2021, as such, the petitioner also deserves to be enlarged on bail. Learned Senior Counsel further submits that co-accused Satyendra Giri, Santoshi Manjhi and Sachchidanand Singh have already been granted bail by order dated 16.11.2021 in Cr. Misc. No. 20596 of 2021, order dated 06.12.2021 in Cr. Misc. No. 28215 of 2021 and order dated 19.01.2022 in Cr. Misc. No. 41242 of 2021 respectively.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 30.12.2021, charge-sheet has been submitted and coaccused have already been granted bail, the petitioner, above named, is directed to be released on bail on furnishing bail bond
