submissions made on behalf of both sides. Admittedly, there is land dispute. Then there is claim of previous litigation between the land owner of the informant and his agnate, the petitioner herein. In the aforesaid background possibility become more definite for false implication. Having regard to the aforesaid facts and circumstances and relying upon the afore-referred two decisions of the Hon’ble Supreme Court, namely, Hitesh Verma’s case and Gorige Pentaiah’s case, I am of the opinion that the appeal ought to be allowed and hence, let the appellant, above-named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bonds of Rs.20,000/(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, SC/ST, Gaya in connection with SC/ST P.S. Case No. 30 of 2021 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with a further condition that the appellant shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the appellant. The petitioner will not in any way contact either the victim or any of the witnesses and tamper with the evidence in any manner.
