Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201 and 120B of the Indian Penal Code.

As per the prosecution case, the dead body of the son of the informant was recovered. It is stated that few days ago he had quarreled with the accused persons. He had dispute with Vishal Kumar, Ankit and Madan over plucking of mangoes.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of the co-accused Raja Ram. It is submitted that the said co-accused Raja Ram had taken the name of co-accused Baidyanath Ram as also

the petitioner herein. Baidyanath Ram has been enlarged on bail vide order dated 16.8.2021 passed in Cr. Misc. No. 11810 of 2021. The petitioner is in custody since 30.6.2020 and has no criminal antecedent.

The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant. It is submitted by learned counsel for the informant that the three accused persons including the petitioner herein confessed to having committed the crime and it was the towel of this petitioner which was used in strangulating the victim.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 1 year 5 months and grant of bail to the coaccused Baidyanath Ram, the petitioner is directed to be enlarged on bail in connection with Sadar (Mobbi O.P.) P.S. Case no. 268 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga.
