Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Athmalgola P.S. Case No. 45 of 2020 registered for the offence under Sections 30(a) of Bihar Prohibition & Excuse Act.

As per allegation in the FIR, a large number of liquor was found in truck bearing no.BR06G-4927 and also a sim of airtel company was recovered from the accused persons.

Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. He further submits that the petitioner is a driver of the said truck and he is in custody since 21.11.2020. He further submits that the petitioner has got no criminal

However, learned APP for the State vehementally opposed the prayer for regular bail.

In the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in Special Case No.1893 of 2020 arising out of Athmalgola P.S. Case No. 45 of 2020.
