Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Mokama P.S. Case No. 204 of 2020 registered for the offence under Sections 341, 323, 364, 34 of the Indian Penal Code.
The case is of kidnapping for demand of ransom of rupees two lakh.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, no occurrence alleged in the F.I.R. has taken place. Neither any ransom amount was demanded nor the same has been paid to anyone. Nothing incriminating has been recovered from the conscious

possession of the petitioner. Charge-sheet in this case has already been submitted. Moreover, the co-accused, namely, Munchun Yadav @ Avinash Kumar, has already been granted bail by a co-ordinate Bench of this Court vide order dated 03.11.2021 passed in Cr. Misc. No. 51900 of 2021. The petitioner is rotting in judicial custody since 04.10.2020.
Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Barh in connection with Mokama P.S. Case No. 204 of 2020.
