2 16-11-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner seeks bail in connection with Siwaipatti P.S. Case No. 13 of 2019 registered for the offences punishable under Sections 341, 324, 326, 354/34 of the Indian Penal Code.
According to prosecution case, while the informant along with her friends was returning after collecting admit card on cycle, the petitioner and other accused pulled her dupatta and when informant protested, she was slapped. She further alleges that petrol was also sprinkled on her body by the accused persons.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and he has falsely been implicated in the present case. Learned counsel

further submits that from perusal of the FIR it appears that nothing specific overt-act has come against the petitioner. Petitioner is in custody since 23.10.2020 having no criminal antecedent. Learned counsel further submits that co-accused Arjun Kumar has been granted regular bail by the court below itself vide order dated 16.06.2021.
The learned Additional Public Prosecutor opposed the prayer of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge cum Special Judge, POCSO Act, Muzaffarpur in connection with Siwaipatti P.S. Case No. 13 of 2019.
