3 03-11-2021 Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 323, 307 and 447 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Athmalgola P..S.Case No. 09 of 2019.

Learned counsel for the petitioners has submitted that petitioners are innocent.

On the other hand, learned APP has submitted that in the FIR there is direct allegation on petitioners of firing shot on the person of the informant. The informant has sustained two injuries, which have been kept reserved for the opinion of the doctor.

Considering the fact that there is specific allegation on

the petitioner no.1 of firing shot on the person of the informant and the two injuries have been sustained by the informant, I am not inclined to grant anticipatory bail to the petitioner no.1. His prayer for anticipatory bail is hereby rejected.

So far as petitioner nos. 2 to 5 are concerned, there is no specific allegation against them. As such, let them, in the event of arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P..S.Case No. 09 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.
