“1. For issuance of an appropriate writ/order/direction upon the Respondents not to encroach the 16 feet road at the northern side of the proposed stadium which is to be constructed at Kheshra No. 78 which is a land belongs to Bettih Raj and is called “Bimal Babu ka Maidan.” The petitioners are resident of Narainapur Blck of Bagaha-02, Ward No. 4 & 5 and the petitioners as well as hundreds of others are utilizing the northern side Kachi Sarak which meets the main road and also goes to Chiran Tola. The 16 Feet Kharanja is the only way through which the public of the area access to the main road.

For issuance of an appropriate writ/order/direction upon the Respondents to construct the stadium without disturbing the approach road at the northern side of “ Bimal Babu ka Maidan” and during pendency of this application, the respondents may be restrained from constructing the stadium and erecting the boundary wall of the stadium on the approach road which is being used by the general public of the aria.”

Learned counsel for the petitioners seeks permission to withdraw the present petition, for with the passage of time the present petition has become infructuous. As such the present petition stands disposed of as withdrawn, reserving liberty to the
