3 19-02-2020 Heard learned counsel for the petitioner and learned
counsel for the respondents.
Petitioner has prayed for the following relief:-
“(i) For issuance of appropriate writ/writs, order/orders, direction/directions to the respondents for conducting an appropriate inquiry into the entire activities and financial irregularities going on by the private respondents i.e. respondents no. 11 to 13 in running the Institution namely S.M. Zaheer Alam Teachers Training College, Bahera, Darbhanga (hereinafter referred to as “the College”).
(ii) For issuance of appropriate writ/writs, order/orders, direction/directions to properly examine as to whether the admission of genuine students have been taken in two years, B.Ed. And D.Ed. Course after charging validly prescribed admission fee and deposit of the same in the Bank account of the College.
(iii) For issuance of appropriate writ/writs, order/orders, direction/directions directing the appropriate respondents to conduct proper investigation in the matter of obtaining minority certificate on protection of false facts and and affidavits by the so-called unauthorized persons i.e. respondent nos. 12 & 14 when the Institution was itself udner the control of the Receiver duly

appointed by the competent court of Law.
(iv) For issuance of appropriate writ/writs, order/orders, direction/directions directing the concerned respondents including the National Council for Teachers Education (hereinafter called as “N.C.T.E.”) as well as Vice Chancellor of Lalit Narayan Mithila University to take steps on the basis of their inquiry report as per inquiry directed by the Hon’ble Court to N.C.T.E. as well as inquiry Team constituted by the Vice Chancellor of Lalit Narayan Mithila University on the basis of the application filed by the petitioner.
(v) For issuance of appropriate writ/writs, order/orders, direction/directions to take appropriate steps on the complaints filed by the petitioner to various authorities as well as complaint filed by Sri Samshul Hoda who is, in fact, a member of the Managing Committee of the Institution.
(vi) For issuance of appropriate writ/writs, order/orders, direction/directions toj the Vice Chancellor of the Lalit Narayan Mithila University to restrain from publishing the result of the illegally admitted students for which the Vice Chancellor illegally granted permission to submit fees and forms without verifying as to whether the students have been validly admitted after deposit of the prescribed admission fees etc. in the Bank account of the College.
(vii) For issuance of appropriate writ/writs, order/orders, direction/directions to conduct the said inquires by the respondents since the 2012-13 henceforth the illgalilties started being committed by he concerned respondents including the private respondents who started collecting huge amount of money in connivance with the University Authorities and thereby pocketed the said amount without deposit in the Bank account of the College. (viii) For issuance of appropriate writ/writs, order/orders, direction/directions directing the

respondents to make thorough inquiry and take immediate action on the aforesaid issues raised by the petitioner in the present Public Interest Litigation”.
Learned counsel for the petitioner seeks permission to withdraw present petition reserving liberty to take recourse to such remedies as are otherwise available in accordance with law which already stands preferred before the appropriate authority.
The application is dismissed as withdrawn with the aforesaid liberty.
