The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302 of the Indian Penal Code.

While the informant along with his father was returning to home after plantation of mustard, the petitioner is said to have dashed his father with his Bolero vehicle with an intention to kill him and due to which he became seriously injured and lastly died. The reason behind the occurrence is said to be that some altercation took place between the informant's father and the petitioner at 2 PM.

petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to enmity. It is further submitted that the whole case is false and it has been engineered afterthought with the connivance of the police and the villagers. It is also submitted that the accident is said to be took place on 12.10.2019 but the F.I.R. has been lodged on 16.10.2019 i.e. after delay of four days but no plausible and convincing reason has been assigned for the said delay. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Siwan in connection with Raghunathpur P.S. Case No. 198 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
