4 13-10-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147/148/149/341/323/307/379/447/504 of the Indian Penal Code.

Allegation against the accused persons including the petitioners is of assaulting the informant and his family members.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties and

both sides have found injuries. The petitioners have got no criminal antecedent.

Learned APP for the State opposes the prayer for bail

petition.

Perused the records and case diary, the injury reports

are grievous in nature.

In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioners on bail. Accordingly, the prayer for anticipatory bail of the petitioners are rejected in connection with Ara Town P.S. Case No. 273 of 2019 from the Court of learned Chief Judicial Magistrate, Bhojpur, Ara.

Accordingly, the application is dismissed.

However, petitioners are directed to surrender before the learned court below and make prayer for bail, the learned court below shall dispose of the bail petition on the same day without being prejudiced by this order.
