Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Tajpur (Waini O.P.) P.S. Case No. 380 of 2019, registered for the offence punishable under Section 30(a), 41(1) and 41(2) of the Bihar Excise and Prohibition Act, 2016.

The allegation is regarding recovery of 754.5 liters of illicit foreign liquor from a pickup van.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner is accused in two other cases, but he is on bail in the said two cases. It is further submitted by referring to paragraph no. 9 of the present petition that he is neither the owner nor the driver of the said

pickup van in question and his name has been roped in the present case on account of confessional statement made by the coaccused persons. The petitioner is stated to be languishing in custody since 6.12.2019

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that no recovery of illicit liquor has been made from the conscious possession of the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II cum Special Judge Excise Samastipur in connection with Tajpur (Waini O.P.) P.S. Case No. 380 of 2019.
