Petitioners seek bail in anticipation of their arrest in connection with Darauli P.S. Case No. 158 of 2019 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code.

As per prosecution case, there is allegation of abusing the informant by the petitioners and others and there is specific allegation against petitioner Nos. 1 and 2 that they gave lathi blow and farsa blow respectively by them on nephew of the informant, namely, Dinanath Yadav and there is allegation against petitioner Nos. 3 and 4 that they assaulted brother of informant, namely, Srikant Yadav and there is also allegation of

assault against other co-accused persons by lathi to his granddaughter.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and injuries on Dinanath Yadav are simple in nature and though one injury on Srikant Yadav is said to be grievous in nature but the same is on the hand.

In view of above facts and circumstances, let petitioners, in the event of surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Siwan, in connection with Darauli P.S. Case No. 158 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
