Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing.

Sole petitioner apprehends his arrest in Hajipur Town P.S. Case No. 1025 of 2019 registered for the offence under Sections 341/323/353/504/506 of the Indian Penal Code.

As per First Information Report, the allegation against the petitioner is that he, in drunken state, threatened a lady doctor to kill her while she was on her duty and despite intervention of the hospital employees, petitioner did not restrained himself, rather used physical force and as such, on account of fear, the doctor confined herself in her duty room causing inconvenience to the other patients also and obstruction in discharge of public duty.

It is submitted on behalf of petitioner that petitioner is

innocent and has committed no offence, as alleged in the FIR. In fact, the petitioner was misbehaved by the informant and other employees of the hospital, since he (petitioner) was adamant for getting his wife treated in the Govt. Hospital, where the informant was posted, as Gynaecologist. It is further submitted that F.I.R. has been lodged after delay of about five days and there is no explanation for the same. The petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application is allowed.

In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 1025 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
