The petitioners apprehend their arrest in Nautan P.S. Case No. 140 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

In the F.I.R., the informant, who is S.H.O. of Nautan Police Station, has alleged that 7 named, which includes petitioners, and 15-20 unknown persons were assaulting one person by fists, slaps, lathi and danda , as a result of which, the said person received some injury. It is further alleged that accused persons also misbehaved with police personnel.

It is submitted on behalf of petitioners that petitioners

are innocent and have committed no offence, as alleged in the FIR. There is no specific overt act against any of the petitioners. It is further submitted that as per injury report (Annexure – 2), the injuries have been found to be simple in nature caused by hard & blunt substance by the doctor. Petitioners have no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application is allowed.

In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Hena Mustafa, learned Judicial Magistrate 1^st Class, Siwan in connection with Nautan P.S. Case No. 140 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
