On account of excess payment to the petitioner an amount of Rs 1,71,670/ was recovered from the petitioner. Assailing said recovery writ petition has been filed.

Counter affidavit discloses that issue was examined by the authorities and after due pay fixation, amount found admissible to the petitioner has been paid during the pendency of these proceedings.

Counsel for the petitioner however, disputes the amount ascertained as per calculation chart (Annexure C to the counter affidavit). He submits that in respect of dispute arising out of calculation, he would approach respondent no.3 by making a representation.

Parties are in agreement that the petitioner may approach respondent no.3 in respect of his remaining grievance by filing representation.

This court only observes that if such representation is filed within a period of four weeks, respondent no.3 (The Senior Manager, North Bihar Power Distribution Co. Ltd, Vidyut Bhawan, Bailey Road, Patna) shall consider the same by reasoned and speaking order and if any due found admissible, same be paid to the petitioner within four weeks thereafter.
