out of Nabinagar P.S. Case No. 23/18, disclosing offences under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and others by means of lathi and tangi causing injuries to them.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case due to land dispute and although there is allegation against the petitioners of assaulting the informant and others, however, the injuries

caused them was found to be simple in nature.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- I, Aurangabad, in connection with Nabinagar P.S. Case No. 23/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
