Petitioners seek bail in anticipation of their arrest in connection with Rosera P.S. Case No. 258 of 2018 registered for the offences punishable under Sections 384 and 387/34 of the Indian Penal Code.

Allegation as per FIR is of demanding extortion of Rs.20 lakh by mobile No. 7547834476 and it appears that during investigation the mobile was found in the name of father of one Anil Sahni and Anil Sahni has named these petitioners.

Submission of learned counsel for the petitioners is that except confessional statement there is nothing against them and though they are accused in one more case but in that case also they have been named on the basis of confessional statement of co-accused. Furthermore, in other case they have

been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc.No. 79264 of 2018 vide order dated 28.1.2019.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, Samastipur, in connection with Rosera P.S. Case No. 258 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitionerd shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
