The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that 6.375 litres of Indian Made Foreign Liquor was recovered from the room in which the petitioner was a tenant.

It is submitted by learned counsel for the petitioner that the house does not belong to the petitioner and statement has been made in paragraph 3 of the petition that the petitioner is accused in one another case but he is on bail in that case, however, statement to that effect has not been made in the petition.

Learned APP submits that the recovery has been made

from the room of the petitioner.

Considering the quantity and nature of recovery, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Special Case No. 1656 of 2019, arising out of Shastrinagar P.S. Case No. 129 of 2019, pending in the Court of learned Special Judge, Excise, Patna.
