The petitioner apprehends his arrest in Naugachia Gopalpur (Rangra O.P.) P.S. Case No.240 of 2019 registered under Section 7 of the Essential Commodities Act.

The Block Supply Officer raided the house of the petitioner and recovered 23.5 quintals rice kept in the bags on which Government of India was inscribed.

Learned counsel for the petitioner submits that mere inscription on the bag in which rice was kept does not mean that the rice was taken from any P.D.S. dealer. There is no control order with regard to dealing in rice. No offence under Section 7

Having considered the facts and the nature of allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3^rd , Naugachia in connection with Naugachia Gopalpur (Rangra O.P.) P.S. Case No.240 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
