3 18-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 304(B)/ 34 of the Indian Penal Code and Sections 498A, 364, 365, 120B IPC has been added but charge sheet has been submitted under Section 498A, 364, 365, 120B.

Prosecution case as lodged by the informant is that her daughter’s marriage has been solemnized with Dhananjay Sah in December, 2015 and due to non-fulfillment of demand of dowry, she has been killed by her husband and in laws.

Learned counsel for the petitioners submits that petitioners are the in-laws and there is no specific allegation against the petitioners. He submits that husband of the victim is in custody. He further submits that petitioners bear no criminal antecedent.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sikrahana at Dhaka, East Champaran in connection with Ghorasahan (Jharokhar) Police Station Case No. 330 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
