The petitioners seek anticipatory bail in connection with Banka (Bharat) P.S. Case No. 14 of 2019 registered for the offence punishable under Sections 147, 149, 353, 431, 283 of the Indian Penal Code.

The prosecution story in brief is that the informant S.I. of Police at Barahat Police Station alleged that on 09.01.2019, the Anganbari Sahayika and Sewika blocked the Bhhera More Chowk, situated between the Bhagalpur-Dumka main road, by Bamboos and Balla and were protesting against the Government and they were creating hindrance due to such protest. Subsequently, traffic was disrupted due to which many vehicles such as Ambulance, School van had to face many difficulties. It is further alleged that when the ladies constables and other officers tried to persuade but the petitioners and 50-60 other Sahayika and Sweika were raising anti-government slogan, which is against the law.

Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence and petitioners have been falsely implicated in this case. He further submits that all the petitioners are ladies and protesting against the Government anomalies to set right their legal demand of their continued work as Anganbari Sahayika and Sewika and

there is no contradiction regarding holding against the Government. He further submits that petitioners were sitting on Dharna for their demand. Petitioners have got no criminal antecedent.

In the facts and circumstances of the case, let the petitioners, named above, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 14 of 2019, subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
