Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Hilsa P.S. Case No. 281 of 2019 registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.

As per allegation, in written report of informant Virendra Kumar, who is the proprietor of “Jewar Mahal” situated at Keshav Bazar, Hilsa that his shop has been running since six months. It is further alleged that first of all one Amin Aged about 60 years came to his shop and purchased some articles by introducing himself resident of Dargahpar, Hilsa and after that he started to come at his shop on interval of few days. He demanded some loan and the informant

advanced him loan on different dates in lieu of, the pledge of ornaments and the details of which are given in written report and after that the informant received a call from Sonu from mobile number 9065581501 who introduced himself son of Ameen and warned the informant not to advance further money to Ameen. It is further alleged that when Ameen came to his shop at that time other co-accused Pintu Kumar, Dharmbeer Kumar and Vikky Kumar also started to come at his shop and they all have pledged ornaments and took money from the informant by showing different reasons, the details of which have also been given in the written report. It is further alleged that the informant denied to advance any more money to Ameen, he made a call to informant and informed that Prabhat is impersonating himself as Pintu. He testified the ornament pledged by them and found that only golden cover was made on the ornaments but it was made of copper; informant called the Pintu at his shop but after that they switched off their mobile. It is further alleged that on search of facebook profile Vikky Kumar was found resident of Khushrupur and nephew of Pintu was found as Sonu Verma.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that there is no direct or indirect evidence against the petitioner to prove his involvement in the alleged offence.

Learned counsel for the informant submits that the coaccused Bipin Kumar has been granted regular bail and there is

specific allegation against the petitioner that he submits false address and when he searched the face book, Vikky Kumar was found resident of Khushrupur and nephew of Pintu was found as Sonu Verma.

Learned counsel for the petitioner submits that there is commercial dispute between the parties.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Hilsa, District- Nalanda in connection with Hilsa P.S. Case No. 281 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
