This application, for grant of anticipatory bail, arises out of Khijarsarai P.S. Case No. 27 of 2019, disclosing offences under Sections 409, 420 and 34 of the Indian Penal Code.
Petitioner happens to be the Panchayat Secretaries and allegation against them is that despite general direction to them to submit the file folders relating to appointment of niyojit teachers, they have not deposited the same.
Submission of learned counsel for the petitioners is that they have already handed over the charge and no documents are available with them and they have falsely been implicated I

Having heard both sides, considering facts and circumstances, let petitioners, above named, surrender before the court below within two weeks from the date of receipt of as copy of this order, on which, the court below shall release them on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Gaya in connection with Khijarsarai P.S. Case No. 27 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is further subject to the condition that they will appear before the Investigating Officer as well as the authorities concerned as and when required, failing which, their bail bonds will be cancelled.
