3 24-09-2019 This application, for grant of anticipatory bail, arises out of Barun P.S. Case No. 149 of 2019, disclosing offences under Sections 341, 323, 324, 307/34 of the Indian Penal Code.

Allegation as per F.I.R. is that son of the informant was called by the petitioners in order to load the sand, thereafter, he was brutally assaulted by the petitioners and report of ultrasonography is also annexed with the F.I.R.

Submission of learned counsel for the petitioners is that entire allegations are vague and petitioners have falsely

been made accused in this case and although, there is allegation of assault, however, the injuries sustained by the son of the informant was found simple in nature.

Learned Counsel for the State could not controvert the submission that the injuries sustained by the injured were found simple in nature.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 149 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
