Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Mansi Rail P.S. Case No. 03/2018, instituted for offence under Section(s) 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that F.I.R. is against unknown. Name of this petitioner has come during investigation. Learned Sessions Judge, Khagaria has mentioned in the impugned order that it is found mentioned in para 30 and 55 of case diary that on the basis of C.D.R. and tower location it has come to light that stolen mobile was used by one Praveen Kumar, who disclosed that he had taken the stolen mobile from the petitioner.

Petitioner is in custody since 11.10.2018.

Considering the aforesaid facts and circumstances,

prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Khagaria in connection with Mansi Rail P.S. Case No. 03/2018 , subject to the conditions that both the bailors shall be the close relative of the petitioner.
