The petitioner seeks regular bail in Masaurhi P.S. Case No. 748/2018 (Special Case No. 9819/2018), registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act.

In the written report it is alleged that police got information that four persons namely, Suresh Saw, Hira Lal Saw, Nagendra Kumar and Sadhu Saw are dealing in sale and purchase of Mahua flower for preparation of Mahua liquour.

Learned counsel for the petitioner has submitted that as per seizure list Mahua flower was recovered from the shop of Nagendra Kumar. Petitioner was arrested from the shop of Nagendra Kumar. He was employee of that shop. There is no

recovery from his possession. He is in custody since 13.10.2018 having clean antecedent.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Masaurhi P.S. Case No. 748/2018 (Special Case No. 9819/18) subject to the condition that both the bailors will be close relative of petitioner.
