The petitioner has challenged the order dated 11.12.2018 passed in Sonbarsa P.S. Case No. 202 of 2018 whereby the learned 4^th Additional Chief Judicial Magistrate, Sitamarhi refused to release the petitioner at her desire.

Petitioner is victim of the crime and is lying for the present in a remand home. The impugned order is being reproduced below:-

From the aforesaid order, it is evident that the learned

Magistrate was conscious that the victim-girl, who is a major, was free to go wherever she desires. Hence, other considerations are against the law causing failure of justice.

Hence, the impugned order is set aside and this application is allowed.

The learned court below as well as the authorities concerned are directed to release the victim immediately.
