A.P.P. for the State.
The petitioner seeks regular bail in Desari (Sahdoi O.P.) P.S. Case No. 319/2018, registered for the offences punishable under Sections 414, 379 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Act.
The informant alleged that he got confidential information that one motorcycle was parked near a Chowmin shop. The informant along with other police officials reached there and saw that this petitioner was to go on that motorcycle, thereafter, informant demanded paper of that motorcycle. It is alleged that on search 360 m.l. of foreign liquour was recovered from the shop of this petitioner.
Learned counsel for the petitioner has submitted that

F.I.R has been lodged by the Sub Inspector of Police. There is no any private complaint made about theft of motorcycle. Petitioner is in custody since 09.11.2018 having clean antecedent.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IInd-cum-Special Judge, Hajipur at Vaishali in connection with Desari (Sahdoi O.P.) P.S. Case No. 319/2018 subject to the condition that both the bailors will be close relative of petitioner.
