2 09-05-2019 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Sahebganj P. S. Case No. 494 of 2018 instituted for the offence under Section(s) 376/511 of the Indian Penal Code read with Sections 4, 6 and 8 of the POCSO Act .

Learned counsel for petitioner submits that petitoenr is an old person aged about 70 years and is suffering from illness. Petitioner has been falsely implicated in this case due to village politics.

In the written report, it is alleged that informant was not keeping good health for past two weeks, then her family members told her that she was under influence of demon. It is

further alleged that some villagers told her about the petitioner that he treats such illness. Thereafter, her parents took her to petitioner for treatment. It is alleged that petitioner took her to lonely place on the pretext of treatment and attempted to commit illegal act with her.

Petitioner is in custody since 2.1.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, POCSO, Muzaffarpur, in connection with Sahebganj P. S. Case No. 494 of 2018, Tr. no. 11/2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
