Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Sikty P. S. Case No. 240/2018 instituted for the offence under Section 304 of the Indian Penal Code.

Learned counsel for petitioner submits that petitioner is not named in the written report. The informant is chowkidar who had given fardbeyan alleging that cattle thief was brutally assaulted by mob, on account of which, he died. The name of this petitioner has come during investigation on the basis of the statement of son of the deceased recorded under Section 164 Cr.P.C. after more than 20 days from lodging of the FIR, wherein, he has raised mere suspicion against this petitioner.

Petitioner is in custody since 22.1.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Araria, in connection with Sikty P. S. Case No. 240/2018, G.R.case no. 4109 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
