Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Special (Excise) Case No. 96 of 2019 (arising out of Sour Bazar P.S. Case No. 55 of 2019) for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016 and Sections 272, 273, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 19.02.2019. He further submits that in the instant case 40 liters liquor was seized but nothing was recovered from the conscious possession of the petitioner and he has no concern with the seized liquor.

antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Special Judge, Excise Act, Saharsa in connection with Special (Excise) Case No. 96 of 2019 (arising out of Sour Bazar P.S. Case No. 55 of 2019).
