Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Dhibra P.S. Case No.11 of 2015 instituted for the offence under Section(s) 147, 148, 149, 120-B, 353, 124-A, 307 Indian Penal Code, Section 17 of the CLA Act, and Sections 25(1-B)a, 26 and 35 of the Arms Act.

Counsel for the petitioner submits that petitioner’s name has surfaced in the written report merely on suspicion. The informant has alleged to have identified 18 accused persons including this petitioner.

In the written report, there is general and omnibus allegation against the petitioner.

Counsel for the petitioner further submits that similarly situated other co-accused have already been granted

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Dhibra P.S. Case No.11 of 2015 , subject to the condition that both the bailors shall be close relative of the petitioner.
