Petitioner in the present case is seeking anticipatory bail in connection with Bhagwan Bazar P.S. Case No. 523 of 2018 registered for the offences punishable under Sections 147, 341, 353 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that while it is true that the petitioner is one of the expelled candidate in the examination but there is no material to show that this petitioner had been participating in the alleged occurrence at the examination centre where examinees along with 20-25 unknown persons had stopped the examination of the 2^nd session and locked the main gate from the outside. It is submitted that after being expelled in the examination the petitioner had gone to his

home and further in the FIR only an ornamental statement has been made that the expelled candidates along with 20-25 unknown persons were creating the problem at the examination centre.

Learned A.P.P. for the State submits that this petitioner was one of the expelled candidates and he was an examinee.

Considering the facts and circumstances of this case, wherein there are general allegations that the candidates expelled from the examination had assembled 20-25 unknown persons at the gate of the examination centre and had locked the main gate and indulged in other kind of nuisance but there is no specific allegation against the petitioner that he was also seen present at the time of alleged occurrence, the petitioner being a student, this Court is willing to extend the benefit of privilege of anticipatory bail to the petitioner in order to give an opportunity to make his wish in life.

Let the petitioner above named, in case of his arrest or surrender within four weeks from today in connection with Bhagwan Bazar P.S. Case No. 523 of 2018, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction
