Heard learned counsel for the petitioner and learned APP for the State.

The present petition has been filed for modification of order dated 05.03.2019 passed in Cr. Misc. No. 12959 of 2019.

Learned counsel for the petitioner submits that the petitioner had been granted provisional bail subject to various conditions and in particular, the condition at para 4(vi) of the relevant order dated 05.03.2019 required him to produce 13 folders claimed to be available with him in original relating to the details of the employed teachers of Sarkatti Saidpur Panchayat, before the learned Court below within a week whereof for appropriate verification. The submission of the petitioner was duly recorded in para 3 of the order only to the extent that charge of 13 folders was given to the petitioner at the time of joining at Sarkatti Saidpur Panchayat. It is stated however that out of the 13 folders only 12 folders were in original whereas only a photocopy of the 13^th folder had been handed over to the petitioner at the time of taking charge as evident from the charge report contained in Annexure-2 to the supplementary affidavit. matter, therefore, the petitioner is unable to produce the 13^th folder in original which was never handed over to him. Accordingly, petitioner reiterates his readiness to produce 12 original folders and photocopy of the 13^th folder as received by him at the time of taking charge.

Learned APP appears and has been heard.

Having regard to the nature of the prayer and securing the ends of justice, condition no. (vi) contained in para 4 of the order dated 05.03.2019 passed in Cr. Misc. No. 12959 of 2019 shall be treated as modified to read as follows --

“(vi) The petitioner shall produce the 12 folders in original and photocopy of the 13^th folder relating to details of employed teachers of Sarkatti Saidpur Panchayat before the learned Court below within one week from today and appropriate verification of the same be carried out by the Block Development Officer, Barh.”

It is made clear that the period of one week mentioned in the aforesaid condition shall be reckoned from today.

The modification petition stands allowed to the extent indicated above.
