The petitioner is apprehending his arrest in connection with Jakkanpur P.S.Case No.327 of 2018 registered for offences punishable under Sections 420, 467, 468, 471, 198 of the Indian Penal Code.

Allegation against the petitioner, who was the then Inspector of Aryabhatt Knowledge University, Patna, is that on the basis of forged academic certificate as well as experience certificate and he got appointment which on inquiry was found to be forged.

Submission of the learned counsel for the petitioner is that after inquiry he has been dismissed from service which is Annexure-28 and against which he has preferred an appeal

before the Chancellor and in the appeal, order of dismissal has been stayed, which will appear from Annexure 29.

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, and especially the fact that as the appeal is pending, let the petitioner, above named, on surrender within four weeks from receipt of the order be enlarged on provisional bail in connection with Jakkanpur P.S.Case No.327 of 2018 dated 19.7.2018 to the satisfaction of court below till conclusion of the appeal, with condition that if appeal is decided against the petitioner, he has to surrender before the learned court below and make prayer for regular bail, which will be considered on the basis of materials available on the record..
