4 01-05-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 864 of 2017, disclosing offences under Sections 498A and 494 of the Indian Penal code.

Allegation against the petitioner, who happens to be

the husband of opposite party no.2, is of subjecting his wife/opposite party no.2 with cruelty and torture.

Submission of learned counsel for the petitioner is that all the allegations are false and concocted and he has ready to pay the maintenance amount, if some reasonable time is given to him.

informant, they have opposed the prayer for anticipatory bail of the petitioner and submitted that order for interim maintenance has been passed in the year 2011, but uptil now not a single penny has been given to opposite party no.2.

Having heard both sides, in view of the facts and circumstances of the case as stated above, let petitioner surrender before the learned court below within a period of six weeks from the date of receipt of the order and pay at least ¼ of the amount, which is due against him and will continue to pay the interim monthly maintenance amount, on such, he will be released on bail by the learned court below on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties each of the like amount each to the satisfaction of court concerned.

It is made clear that if the petitioner failed to deposit interim monthly maintenance amount to the opposite party no.2 continuously for three months, then opposite party no.2 shall be at liberty to move for cancellation of his bail bonds before the learned court below itself.
