Heard learned counsel for the petitioners as well as

learned Additional Public Prosecutor for the State.

Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 120B, 420, 406, 388, 414/34 of the Indian Penal Code.

Petitioner no. 1 happens to be Ex Acting Chairman whereas petitioner no. 2 happens to be Director cum Incharge of Bihar State Rural Co-operative Housing Federation Limited, Patna.

The contents of complaint petition go to show that

it was co-accused Dharmendra Kumar, who fled away with relevant documents and, furthermore, it was co-accused Baiju Prasad, who subsequently transferred the lands in question in favour of co-accused Pramila Devi. So far as petitioners are concerned, it is only alleged that being officials of the society they helped the aforesaid accused in committing the alleged crime.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, above named, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Judge-XI cum Additional Chief Judicial Magistrate, Patna in connection with Complain Case No. 1787 (C) of 2012 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
