02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with R.P.F Post Mokama case no. 05/2017 registered under section 3 RP(UP) Act, 1966.

The petitioner is not named in the prosecution report and it appears from perusal of impugned order dated 24.07.2018 that one co-accused Balmiki Mahto was arrested and named the petitioner in his confessional statement. It appears that except the aforesaid confessional statement, there is nothing against the petitioner.

Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this

order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Railway, Patna in R.P.F Post Mokama case no. 05/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
