Heard learned counsel for the petitioner and the
learned APP for the State.
The petitioner seeks bail in Dariyapur P. S. Case No 164 of 2018 instituted for the offence under Section(s) 30, 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is submitted that police has recovered 1800 liters of spirit from three different places. It is alleged that 200 liters of spirit has been recovered from the land of this petitioner.
Learned counsel for the petitioner has submitted that petitioner was not present on the spot. Seizure list does not bear his signature. There is no recovery from land of petitioner.
Petitioner is in custody since 28.6.2018

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 6th Additional Sessions Judge, Saran at Chapra, in connection with Dariyapur P.S. case no. 164 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
