2 11-12-2018 Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Kishanganj P.S. Case No. 357 of 2018 for the offence under Sections 420, 201, 120(B) I.P.C. & Section 11 Gambling Act and Section 3/ 4 of the Bihar Lottery Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. The instant case was registered on the self statement of SHO Adarsh Thana Kishanganj. From perusal of the F.I.R., it appears that the petitioner was among the people who was involved in speculating in relation to IPL matches. Learned counsel for the petitioner submits that petitioner is innocent and he has no criminal antecedent and similarly circumstanced other co-

accused Yash Sharma and Santy Singh have already been granted anticipatory bail by co-ordinate Bench of this Court in Crl. Misc. No. 41912 of 2018 dated 19.7.2018 and Crl. Misc. No. 46879 of 2018 dated 25.8.2018 respectively.

Considering the aforesaid fact that similarly circumstanced other co-accused Yash Sharma and Santy Singh have already been granted anticipatory bail by co-ordinate Bench of this Court in Crl. Misc. No. 41912 of 2018 dated 19.7.2018 and Crl. Misc. No. 46879 of 2018 dated 25.8.2018 respectively and petitioner has got no criminal history, let the petitioner above named, in the event of arrest or surrender within one moth from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 357 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
